JUNE 12, 2012 — SIXTEENTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS The Board of Supervisors met on Tuesday, June 12, 2012 at 10:00 a.m. Board members present were Monson, Tripp, Clausen, Boykin, and Smith. Staff members present were Karen James, Board Administrative Coordinator and Patrick F. Gill, Auditor/Clerk to the Board. The Board of Supervisors canvassed the General Primary Election held on the 5th day of June, 2012 with the following official results: Steve Hofmeyer, Deputy Commissioner of Elections, announced there were five (5) provisional ballots of which four (4) were accepted and added to the Tally, and thirty-eight (38) after-election absentee ballots, of which thirty-three (33) were timely postmarked and added to the Tally. Carried 5-0. The meeting was called to order. Motion by Tripp second by Monson to approve the minutes of the 06/05/2012 Board meeting. Carried 4-0; Boykin abstained. Copy filed. The Board approved the reclassification of Dennis Butler, Budget/Tax Analyst, Board Administration Dept., effective 07-01-12, $78,757/year, 9.7%/$6,964/year. Additional duties assigned. Copy filed. The Board approved the reclassification of Benjamin Kusler, Project Engineer, Secondary Roads Dept., effective 07-01-12, $69,106/year, 6%/$3,912/year. Additional duties assigned. Copy filed. Motion by Boykin second by Monson to extend hours for existing position, F/T Clerk II, Veteran Affairs Dept., Current Wage: $13.42/hour. Carried 5-0. Copy filed. Motion by Monson second by Boykin to implement a $439,737.00 insurance premium holiday for the month of July, 2012 for Woodbury County Health Insurance. Carried 5-0. Motion by Boykin second by Clausen to approve a Travel Policy and Expense Policy effective July 1, 2012.. Carried 5-0. Motion by Boykin second by Tripp to approve and authorize the Chairperson to sign a Resolution approving petition for suspension of taxes through the redemption process for Suzanne Jaynes-Hall, 224 So. Leonard St., Sioux City, parcel #894730407006. Carried 5-0. WOODBURY COUNTY, IOWA Parcel # 894730407006 WHEREAS, Suzanne Jaynes-Hall, as joint titleholders of the aforementioned property has petitioned the Board of Supervisors for a suspension of taxes pursuant to the 1999 Iowa Code Section 447.9(3) and, WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby directs the County Auditor to redeem this property Parcel #894730407006 owned by the petitioner from the holder of a certificate of purchase of the amount necessary to redeem under section 447.1, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this parcel. SO RESOLVED this 12th day of June, 2012. Motion by Boykin second by Monson to approve and authorize the Chairperson to sign a Resolution approving a petition for suspension of taxes for Patricia Ege, 1910 Cavalier Way, Sioux City, parcel #894823153008. Carried 5-0. WOODBURY COUNTY, IOWA WHEREAS, Patricia L. Ege is the titleholder of property located at 1910 Cavalier Way Sioux City, Woodbury County, Iowa, and legally described as follows: Lot Eight (8) Block Three (3) Riverview Estates 4T Addition, City of Sioux City, Woodbury County, Iowa WHEREAS, Patricia L. Ege is the titleholder of the aforementioned property have petitioned the Board of Supervisors for a suspension of taxes pursuant to the 2009 Iowa Code section 427.9, and WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby grants the request for a suspension of taxes, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this property. SO RESOLVED this 12th day of June, 2012. A public hearing was held at 10:15 a.m. for the sale of property parcel #245985 (1618 Nebraska St., Sioux City). The Chairman called on anyone wishing to be heard. Motion by Clausen second by Boykin to approve the Contract for Design Work for County Structure X9 in Section 2 of Liston Township with Calhoun Burns and Associates per recommendation of County Engineer Mark Nahra. Carried 5-0. Motion by Tripp second by Monson to approve the contract for Project Number Fm-CO97(116)—55-97, Reinforced Concrete Box Culvert Replacement on County Road K64 South of Moville per recommendation of County Engineer Mark Nahra. Carried 5-0. 1) Motion by Boykin second by Monson to approve and authorize the Chairperson to sign a Resolution levying special assessment of $ for the Bennett-McDonald Drainage District for fiscal year 2012-2013, per recommendation of the County Engineer. Carried 5-0. WOODBURY COUNTY, IOWA WHEREAS, the Woodbury County Board of Supervisors is the governing body of the Bennett-McDonald Drainage District of Woodbury County, Iowa; and NOW, THEREFORE, IT IS HEREBY RESOLVED by the Woodbury County Board of Supervisors as the governing body of the Bennett-McDonald Drainage District, that a special tax and/or assessment in the sum of $ 1,000 be levied against all the tracts of land, lots, railroad companies and public highways within said Drainage District, same to be in the same ratio and upon the same classification as heretofore established, adopted and confirmed. BE IT FURTHER RESOLVED that the said levy and/or assessment be and the same is hereby certified to the Woodbury County Auditor who is hereby directed to effect said levy and/or assessment against all of the said lands, etc., in the same ratio and upon the same classification as heretofore adopted, established and confirmed and enter same upon the tax list of Woodbury County for collection with the first half of the current year real estate taxes. DATED this 12th day of June, 2012. 2) Motion by Tripp second by Monson to approve and authorize the Chairperson to sign a Resolution levying special assessment of $ for the Hackley Lateral Drainage District for fiscal year 2012-2013, per recommendation of the County Engineer. Carried 5-0. WOODBURY COUNTY, IOWA WHEREAS, the Woodbury County Board of Supervisors is the governing body of the Hackley Lateral Drainage District of Woodbury County, Iowa; and WHEREAS, said Board, as Trustees, has determined that it is necessary to levy a special tax and/or assessment on all tracts of land, lots, railroad companies and public highways within the boundaries of the said Drainage District. NOW, THEREFORE, IT IS HEREBY RESOLVED by the Woodbury County Board of Supervisors as the governing body of the Hackley Lateral Drainage District, that a special tax and/or assessment in the sum of $ 13,500 be levied against all the tracts of land, lots, railroad companies and public highways within said Drainage District, same to be in the same ratio and upon the same classification as heretofore established, adopted and confirmed. BE IT FURTHER RESOLVED that the said levy and/or assessment be and the same is hereby certified to the Woodbury County Auditor who is hereby directed to effect said levy and/or assessment against all of the said lands, etc., in the same ratio and upon the same classification as heretofore adopted, established and confirmed and enter same upon the tax list of Woodbury County for collection with the first half of the current year real estate taxes. DATED this 12th day of June, 2012. 3) Motion by Tripp second by Monson to approve and authorize the Chairperson to sign a Resolution levying special assessment of $ for the Orton Slough Drainage District for fiscal year 2012-2013, per recommendation of the County Engineer. Carried 5-0. WOODBURY COUNTY, IOWA WHEREAS, said Board, as Trustees, has determined that it is necessary to levy a special tax and/or assessment on all tracts of land, lots, railroad companies and public highways within the boundaries of the said Drainage District. NOW, THEREFORE, IT IS HEREBY RESOLVED by the Woodbury County Board of Supervisors as the governing body of the Orton Slough Drainage District, that a special tax and/or assessment in the sum of $ 1,500 be levied against all the tracts of land, lots, railroad companies and public highways within said Drainage District, same to be in the same ratio and upon the same classification as heretofore established, adopted and confirmed. BE IT FURTHER RESOLVED that the said levy and/or assessment be and the same is hereby certified to the Woodbury County Auditor who is hereby directed to effect said levy and/or assessment against all of the said lands, etc., in the same ratio and upon the same classification as heretofore adopted, established and confirmed and enter same upon the tax list of Woodbury County for collection with the first half of the current year real estate taxes. DATED this 12th day of June, 2012. 4) Motion by Monson second by Boykin to approve and authorize the Chairperson to sign a Resolution levying special assessment of $ for the Smithland Drainage District for fiscal year 2012-2013, per recommendation of the County Engineer. Carried 5-0. WOODBURY COUNTY, IOWA WHEREAS, said Board, as Trustees, has determined that it is necessary to levy a special tax and/or assessment on all tracts of land, lots, railroad companies, and public highways within the boundaries of the said Drainage District. NOW, THEREFORE, IT IS HEREBY RESOLVED by the Woodbury County Board of Supervisors as the governing body of the Smithland Drainage District, that a special tax and/or assessment in the sum of $ 5,000 be levied against all the tracts of land, lots, railroad companies, and public highways within said Drainage District and same to be in the same ratio and upon the same classification as heretofore established, adopted and confirmed. BE IT FURTHER RESOLVED that the said levy and/or assessment be and the same is hereby certified to the Woodbury County Auditor who is hereby directed to effect said levy and/or assessment against all of the said lands, etc., in the same ratio and upon the same classification as heretofore adopted, established and confirmed and enter same upon the tax list of Woodbury County for collection with the first half of the current year real estate taxes. DATED this 12th day of June, 2012. 5) Motion by Clausen second by Boykin to approve and authorize the Chairperson to sign a Resolution levying special assessment of $ for the Smokey Hollow Drainage District for fiscal year 2012-2013, per recommendation of the County Engineer. Carried 5-0. WOODBURY COUNTY, IOWA WHEREAS, said Board, as Trustees, has determined that it is necessary to levy a special tax and/or assessment on all tracts of land, lots, railroad companies and public highways within the boundaries of the said Drainage District. NOW, THEREFORE, IT IS HEREBY RESOLVED by the Woodbury County Board of Supervisors as the governing body of the Smoky Hollow Drainage District, that a special tax and/or assessment in the sum of $ 0.00 be levied against all the tracts of land, lots, railroad companies and public highways within said Drainage District, same to be in the same ratio and upon the same classification as heretofore established, adopted and confirmed. BE IT FURTHER RESOLVED that the said levy and/or assessment be and the same is hereby certified to the Woodbury County Auditor who is hereby directed to effect said levy and/or assessment against all of the said lands, etc., in the same ratio and upon the same classification as heretofore adopted, established and confirmed and enter same upon the tax list of Woodbury County for collection with the first half of the current year real estate taxes. DATED this 12th day of, 2012. 6) Motion by Monson second by Tripp to approve and authorize the Chairperson to sign a Resolution levying special assessment of $ for the Upper Wolf Creek Drainage District for fiscal year 2012-2013, per recommendation of the County Engineer. Carried 5-0. WOODBURY COUNTY, IOWA NOW, THEREFORE, IT IS HEREBY RESOLVED by the Woodbury County Board of Supervisors as the governing body of the Upper Wolf Creek Drainage District, that a special tax and/or assessment in the sum of $ 7,500 be levied against all the tracts of land, lots, railroad companies and public highways within said Drainage District, same to be in the same ratio and upon the same classification as heretofore established, adopted and confirmed. BE IT FURTHER RESOLVED that the said levy and/or assessment be and the same is hereby certified to the Woodbury County Auditor who is hereby directed to effect said levy and/or assessment against all of the said lands, etc., in the same ratio and upon the same classification as heretofore adopted, established and confirmed and enter same upon the tax list of Woodbury County for collection with the first half of the current year real estate taxes. DATED this 12th day of June, 2012. 7) Motion by Boykin second by Clausen to approve and authorize the Chairperson to sign a Resolution levying special assessment of $ for the Weber Creek Drainage District for fiscal year 2012-2013, per recommendation of the County Engineer. Carried 5-0. WOODBURY COUNTY, IOWA WHEREAS, said Board, as Trustees, has determined that it is necessary to levy a special tax and/or assessment on all tracts of land, lots, railroad companies and public highways within the boundaries of the said Drainage District. NOW, THEREFORE, IT IS HEREBY RESOLVED by the Woodbury County Board of Supervisors as the governing body of the Weber Creek Drainage District, that a special tax and/or assessment in the sum of $ 500 be levied against all the tracts of land, lots, railroad companies and public highways within said Drainage District, same to be in the same ratio and upon the same classification as heretofore established, adopted and confirmed. BE IT FURTHER RESOLVED that the said levy and/or assessment be and the same is hereby certified to the Woodbury County Auditor who is hereby directed to effect said levy and/or assessment against all of the said lands, etc., in the same ratio and upon the same classification as heretofore adopted, established and confirmed and enter same upon the tax list of Woodbury County for collection with the first half of the current year real estate taxes. DATED this 12th day of June, 2012. 8) Motion by Monson second by Boykin to approve and authorize the Chairperson to sign a Resolution levying special assessment of $ for the Wolf Creek Drainage District for fiscal year 2012-2013, per recommendation of the County Engineer. WOODBURY COUNTY, IOWA WHEREAS, the Woodbury County Board of Supervisors is the governing body of the Wolf Creek Drainage District of Woodbury County, Iowa; and WHEREAS, said Board, as Trustees, has determined that it is necessary to levy a special tax and/or assessment on all tracts of land, lots, railroad companies and public highways within the boundaries of the said Drainage District. NOW, THEREFORE, IT IS HEREBY RESOLVED by the Woodbury County Board of Supervisors as the governing body of the Wolf Creek Drainage District, that a special tax and/or assessment in the sum of $ 2,000 be levied against all the tracts of land, lots, railroad companies and public highways within said Drainage District, same to be in the same ratio and upon the same classification as heretofore established, adopted and confirmed. BE IT FURTHER RESOLVED that the said levy and/or assessment be and the same is hereby certified to the Woodbury County Auditor who is hereby directed to effect said levy and/or assessment against all of the said lands, etc., in the same ratio and upon the same classification as heretofore adopted, established and confirmed and enter same upon the tax list of Woodbury County for collection with the first half of the current year real estate taxes. DATED this 12th day of June, 2012. 9) Motion by Tripp second by Boykin to approve and authorize the Chairperson to sign a Resolution levying special assessment of $ for the Wolf Creek Pump Sub-District 2 Drainage District for fiscal year 2012-2013, per recommendation of the County Engineer. WOODBURY COUNTY, IOWA WHEREAS, said Board, as Trustees, has determined that it is necessary to levy a special tax and/or assessment on all tracts of land, lots, railroad companies, and public highways within the boundaries of the said Pumping District. NOW, THEREFORE, IT IS HEREBY RESOLVED by the Woodbury County Board of Supervisors as the governing body of the Wolf Creek Pumping District #2, that a special tax and/or assessment in the sum of $ 5,500 be levied against all the tracts of land, lots, railroad companies, and public highways within said Pumping District and same to be in the same ratio and upon the same classification as heretofore established, adopted and confirmed. BE IT FURTHER RESOLVED that the said levy and/or assessment be and the same is hereby certified to the Woodbury County Auditor who is hereby directed to effect said levy and/or assessment against all of the said lands, etc., in the same ratio and upon the same classification as heretofore adopted, established and confirmed and enter same upon the tax list of Woodbury County for collection with the first half of the current year real estate taxes. DATED this 12th day of June, 2012. 10) Motion by Clausen second by Boykin to approve and authorize the Chairperson to sign a Resolution levying special assessment of $ for the Wolf Creek Pump Sub-District 3 Drainage District for fiscal year 2012-2013, per recommendation of the County Engineer. WOODBURY COUNTY, IOWA WHEREAS, said Board, as Trustees, has determined that it is necessary to levy a special tax and/or assessment on all tracts of land, lots, railroad companies, and public highways within the boundaries of the said Pumping District. NOW, THEREFORE, IT IS HEREBY RESOLVED by the Woodbury County Board of Supervisors as the governing body of the Wolf Creek Pumping District #3, that a special tax and/or assessment in the sum of $ 0.00 be levied against all the tracts of land, lots, railroad companies, and public highways within said Pumping District and same to be in the same ratio and upon the same classification as heretofore established, adopted and confirmed. BE IT FURTHER RESOLVED that the said levy and/or assessment be and the same is hereby certified to the Woodbury County Auditor who is hereby directed to effect said levy and/or assessment against all of the said lands, etc., in the same ratio and upon the same classification as heretofore adopted, established and confirmed and enter same upon the tax list of Woodbury County for collection with the first half of the current year real estate taxes. The Chairperson asked if there were any individuals or groups wishing to make a presentation of items not on the agenda, or Supervisors concerns.
